Federal Judge Finds Justice Department Lawyers Knowingly Lied And Orders Team To Take Ethics Classes

US-DeptOfJustice-Seal_svgJudge_Andrew_S._HanenUnited States District Judge Andrew Hanen issued a remarkable opinion yesterday that found that Justice Department lawyers not only lied to him and opposing counsel but "it is hard to imagine a more serious, more calculated plan of unethical conduct." What is even more remarkable however is that, after describing such a calculated and unethical record, Hanen ordered the lawyers to simply take ethics classes rather than refer them to the bar for suspension or disbarment. Many attorneys object that government lawyers routinely escape serious punishment for false or misleading statements. In this case, the judge found that the Justice Department misled him and opposing counsel in a case by Texas and 25 other states that sought to block President Barack Obama's controversial immigration programs. Hansen blocked the program. Notably, the Justice Department is even opposing ethical classes as a sanction.

    Couldn't the judge at least have charged them with contempt ? Can a judge charge someone with obstruction of justice, or does that have to come from the just-us department? Thousands of innocent people are charged with "conspiracy" to violate laws. Can any "officer of the court" bring these charges against the just-us department?

      A contempt finding must be based upon a failure to obey an order in front of a judge (direct contempt) or out of court (indirect contempt). An obstruction of justice charge must be initiated by a prosector with jurisdiction over the matter. The judge can refer matters to a prosecuting authority for potential charges but cannot bring the charges himself/herself. Of course, the judge can also refer unethical conduct to the relevant bar or the office for whom the prosecutor works. But the judge himself is not a prosector in the general sense (unless one lives in France). This is a good thing by the way. Does anyone here remember just a few weeks ago when, on this very forum, people were fulminating against a judge for making a contempt finding in a tax protester case? I believe posters used language like "dictator" to describe the judge. Now we get calls for judicial prosecution. Consistency anyone?

        No call for judicial prosecution, jab. Just a question on the law since I also remembered the recent contempt charge and was not certain what powers the judge had. I agree that federal judges are just as corruptible as the federal prosecutors, and was not urging more power for them. Consistent and ethical application laws passed by elected representatives of the people would be appreciated. Thanks for providing more clarity on the existing powers, jab.

    Would be a happy day for the judge to check on execution of his judgement, and if they haven't taken ethics classes, disbar the lot of them.

    That will send a message to those clowns we pay to do the right thing...just like all the private company attorneys and executives.

    If you think there is any hope in indicting Clinton check this one. Not only was the Judge lied to he then did not refer them for disbarment but made the sentence a mandatory ethics class. The Justice Department lawyers just ignored that part and the reason is we shall probably find Loretta Lynch and Obama.

      FBI is generally a little above the political fray, I suspect they might refer her for prosecution, but it will die there with 'prosecutorial discretion'.

      The facts of her case are pretty black and white, her staff it seems knowingly copy & pasted out of the federal government's secure email system (separate of their regular email) and pasted the contents into plain email so it could be sent to her email address. The encryption system doesn't work with Blackberries, standard SMTP transport, etc. Blackberry is a Canadian company and its servers are not on US soil, it would have never been certified, even if they made the attempt to.

      Once on her server, according to 60 Minutes... the hackers in Romania apparently snagged everything she ever read or wrote... So, emails that were copy & pasted out of the secure system into Hillary-Mail... well... that's a federal felony... Actions were taken to knowingly circumvent the classification system and those actions resulted in disclosure of classified material to 3rd parties. Apparently, some were even NRO drone surveillance photos, etc. And it would be expected so, you can assume that the Secretary of State would be involved in decisions to assassinate suspected terrorists, and the case file sent to the President's team involved in that decision would include the evidence of their ties, one would assume.

      I'm very certain she is guilty of multiple crimes, and probably much more so than many other people that have already been prosecuted for lesser offenses are. Many of those are serving long prison sentences. People forget about Governor Bill's standard operating procedure of a blowjob for a pardon when it came to women whose husbands were in Arkansas prison.

      These two are sickeningly immune to the standards that it is expected that others live by. If you recall, Hillary was in charge of billing & daily operations at the Rose Law Firm. The one thing 'ethics wise' that will put a lawyer in jail is over-billing a client. There were a rash of complaints about over-billing from Rose Law, and conveniently the billing records disappeared for all of Bill's Presidency. Hillary had no idea, she was baking cookies remember? Then they were conveniently found upon 'clearing out' of the public housing and were apparently in her night stand in their supposed marital bedroom. Also conveniently beyond the statute of limitations...

      And there was Bill's booze-cruises on a private 727 owned by a donor of his that was later convicted of handing out underage prostitutes to his friends...

      These two are a piece of work, it is a never-ending amazement to me how they survive, absolute proof of the idiocy of the average American.

      What's the common thread? 2 more lawyers...

    How do you know a lawyer is lying? The lips are moving... Unfortunately what passes for ethical behavior for the law profession would incur serious legal consequences in any other it often seems like.

    I saw this the other day and was almost shocked. But it takes a lot to shock me anymore. Lying to a judge and getting 3 hours of "ethics" classes??? JM&J, when I was an employee at a big corporation in the mid-90's (that's 20 years ago folks), we were made to sit through about 40 hours of "diversity" training. The only thing those accomplished was to make the company who supplied the "facilitators" a tidy sum of loot. Just another run-of-the-mill travesty in the "justice" system.

        Note the scare quotes...the really, really scary quotes...unlike most of the people in this country (present group excluded) IMO The Rule of Law in Man's greatest political achievement...without that, it truly will be the "dog-eat-dog" world people criticize Capitalism for creating...the true irony being that Capitalism blew that world away, and it's return is only a regression...

    Would not be surprised if the judge in question is referred for a mental evaluation. That used to happen all the time in the former Soviet Union.
