The Why of History Flag Controversy (1)
The US Government doesn't like to change a position nor comment on it if they can put it off to the States or Local Governments. Examples are the Haller vs. DC case where they sidestepped the issues of 9th and 10th Amendment Powers Not Granted. Another is Texas a former independent Republic that joined the Union with the right to secede but instead took up arms as part of the Confederacy - and was brought back into the Union by force of arms. Yet another the reason why Jefferson Davis was never tried and not finally the Flag issue.
The USA took the position that the CSA government was illegal and refused to recognize it. All of Lincolns offers were aimed a the State Governments not the CSA Government. The position was if they tried Jefferson Davis they legitimized the Confederate Government. The same applies to the flag of the Confederacy. It's easier and maintains a position of federalist power to let some things accrue to the States or in this case private business and individual choice. But don't mention the last one. Recognize the flag even by banning offers a reversal of position which is useful in other and perhaps future ways.

Question. The number of hands on the Suribachi flag pole - metal pipe is odd not even with two for every Marine plus one. If you never noticed the explanation given is given as it is the hand of God although some say the Gunny and others see no difference.

2. As I suggested the supreme court doesn't seem to have banned anything but has said each State can remove the Confederate Battle Flag from their license plates. Leaving it squarely as State issue. Can remove and shall remove are two different things. Once again the court sides with popular sovereignty and refuses to do anything that would recognize the existence of the CSA as a government.
South Carolina has agreed to debate Mississippi which was the last state to abolish slavery in 1995 - has agreed to talk about it.
The rest of the hubbub was a combination of citizen choice, state choice and a business choice and media hype. Actually I thought the Confederate Battle Flag was the national flag of the CSA. But apparently only for the military.
Add Texas to that list the Court said Texas has the right to refuse that particular license plate design. Their choice.
