The US Government doesn't like to change a position nor comment on it if they can put it off to the States or Local Governments. Examples are the Haller vs. DC case where they sidestepped the issues of 9th and 10th Amendment Powers Not Granted. Another is Texas a former independent Republic that joined the Union with the right to secede but instead took up arms as part of the Confederacy - and was brought back into the Union by force of arms. Yet another the reason why Jefferson Davis was never tried and not finally the Flag issue.

The USA took the position that the CSA government was illegal and refused to recognize it. All of Lincolns offers were aimed a the State Governments not the CSA Government. The position was if they tried Jefferson Davis they legitimized the Confederate Government. The same applies to the flag of the Confederacy. It's easier and maintains a position of federalist power to let some things accrue to the States or in this case private business and individual choice. But don't mention the last one. Recognize the flag even by banning offers a reversal of position which is useful in other and perhaps future ways.

    I'm a simple guy trying to deal with what becomes, in many cases, inordinately tangled issues. As to the American Flag: Whenever I se or here the flag being defiled, I think of the famous picture of the Marines raising it on Mount Suribachi on Iwo Jima. All I need to know is what it symbolized to those guys who paid for its position there in blood, sweat, and tears.

      A lot more than having the names of the dead buried in a hole in the ground I can tell you that.

      Question. The number of hands on the Suribachi flag pole - metal pipe is odd not even with two for every Marine plus one. If you never noticed the explanation given is given as it is the hand of God although some say the Gunny and others see no difference.

    First mistake : the "offending flag" was NEVER the Flag of the CSA

      Ah thank you? So who did it belong to and what flag did the CSA use? Google time.

          Njumber6 is correct. The flag in question was used by the Army of Tennessee and the Army of Northern Virginia which designated their area of operation but were not State but Confederation military organizations However...

          It's main use was to differentiate units of the North and the South for the manuever commanders.

    If confederate states wanted to secede from the "union", I dont get why the union should have fought them into submission in the first place. The US government even then was really into capturing and taking over all the land between the Atlantic and Pacific- regardless. To hell with the Indians who were there first, the spanish, the french, the mexicans, even the mormons. And we complain about what Russia does today? It was the same thing that the US did.

    I don't buy your reasoning. Lincoln did not recognize the Confederacy as a nation but he did recognize it as a belligerent. Otherwise the Laws of War could not have applied, and prisoners on both sides would have suffered more than they did -- if they even took prisoners.

    Apparently there were four and one had two uses so five is sometimes claimed The first, second, and third official confederate flag and the Battle Flag used by the Army also served the as the CSA Navy Battle Ensign from 1863 and is the most well known did not represent the civilian government but did represent the military of the Confederacy. Commonly called the Southern Cross.

    2. As I suggested the supreme court doesn't seem to have banned anything but has said each State can remove the Confederate Battle Flag from their license plates. Leaving it squarely as State issue. Can remove and shall remove are two different things. Once again the court sides with popular sovereignty and refuses to do anything that would recognize the existence of the CSA as a government.

    South Carolina has agreed to debate Mississippi which was the last state to abolish slavery in 1995 - has agreed to talk about it.

    The rest of the hubbub was a combination of citizen choice, state choice and a business choice and media hype. Actually I thought the Confederate Battle Flag was the national flag of the CSA. But apparently only for the military.

    Add Texas to that list the Court said Texas has the right to refuse that particular license plate design. Their choice.
