Technically we have been under martial law since this time. The standing military was to protect the country borders and the States to organize militia for defenses on The Land. The Standing military cannot govern the country and was in a position of seeming impotence as to what happens within the boundaries of the United States and its' respective territories.
In 1871 Grant signed The Organic Act. This made DC a territory, not of The States and set up governance by a corporation until such time as The States reassemble.
WE, State by State, are in the process of this lawful assembly. This is why the J-6 protesters can be prosecuted. They were on foreign soil.
As I comprehend, when 38 States are formally assembled, we may terminate the Contract Services Management corporation known as The United States (corporation) and return to We The People governance.
First Ammendment: "the right to peacefully assemble". This is not just to gather in informal groups.
