While this is not the way it is, nor the way the Framers intended it to be, the courts have no authority by way of the Constitution to determine what is and isn't Constitutional, its something they granted themselves. The fact that today they are permitted this transgression is why they hold influence over society regardless of what society wants.

I'm not sure what you mean. Federal Judges have the authority to hold hearings and render verdicts based on lawsuits brought by State Attorney Generals which challenge the Constitutionality of Executive Orders. There were many challenges made to Obama's unilateral alterations to his own ACA which delayed certain privileges, etc.

The problem I have in this case is that these judges aren't using any laws to nullify the EO - they're trying to claim that the bias in the EO nullfies it. The code of the statute, however, doesn't care what the bias is - it simply gives carte blanche discretion to the President. The judges are reading something into their interpretation which doesn't exist - anywhere - and using that as the basis for overturning the travel bans. It should get them a one-way ticket to disbarment.

They have no jurisdiction over executive orders. The voice is moot.

The bigger issue is that these judges are specifically ignoring the appropriate statute passed way back under Eisenhower which specifically grants to the President the ability to restrict travel and visa applications from countries deemed to be dangerous.

It is amazing. A rule created by an Executive Order can be ended by an Executive Order. Seems simple enough to understand, unless you are an Obama-appointed judge. There needs to be a reform not only of how judges are appointed, but in the system itself. I proposed one such reform (I am a lawyer), but establishment publications will not publish it.

DACA wasn't even a law - it was a knowingly-unConstitutional Executive Order that should have gotten Barack Obama Impeached and Convicted solely on that one case alone. The power to regulate immigration is specifically given to the Legislative Branch to oversee and Obama even admitted he didn't have the Constitutional authority but did it anyway.

What I would like to see is an automatic trigger provision where if a judge's rulings are overturned by higher courts more than three times in a year their appointments must then be ratified AGAIN by the Senate for them to remain as judges. Properly, these kinds of judges would be Impeached, but the legislature's history on impeachment of the Judicial branch is a joke.

What I find bizarre is that "Black Panther" is the movie that the PC police are raving about. It depicts an authoritarian ruler who builds a wall around his country to keep out those he considers dangerous, and keep his race pure. I guess it's OK for people of color to do all the things that are being labeled "racist" when others attempt the same.

DACA is caca. It was wrong at the beginning it will be worse at the end. DACA has never been about humanitarian relief. It has always been about bolstering a failing political party as American citizens awaken to the realities of a political monarchy system created due to lack of term limits at all national level positions. In essence, at the most basic level, those arguing for DACA are arguing against American sovereignty.
This issue reminds me of a recent trip I made to Mexico. While boarding our plane in Dallas to Puerto Vallarta, the agent continuously insisted we have our passport in hand, not to inspect, but to ensure we had one. The agent also said that if we arrived in Mexico without a passport, we would be immediately "be sent back on the next plane out." The irony was inescapable.

And if George Sorros gets his way, there will be more Liberal judges. He's putting a huge amount of money into backing Democrat candidate judges and lawmakers who support open borders, etc. His candidates have been winning. This is CHILLING.

It was an unconstitutional executive order to begin with, a temporary onecat that. It was never law therefore they have nothing to judge. It expired. Oh fkin well.
