The President is creating a crime by executive fiat. Only congress may create a crime and then only by passing a bill and having the president sign it into law.
Obama is trying to cow the business into not lowering their head cout by saying they cannot lower the head count unless it is not due to ObamaCare and then swear to it under the penalty of perjury.
