Sorry, that would require a HUGE constitutional amendment that our Rulers will never let get to 1st base. Entities of most-all types exempt their boards from personal liability for virtually anything they might do, and GOVERNment is the worst of the lot!

Bill of Rights beginning with the requirement for probable cause and all the follow up stuff such as attorneys, warrants, courts, judges, juries etc. now reads, "suspicion of terrorism." Terrorism is not defined. Without those amendments and the rest of the first ten the balance of the document is moot.

The problem with the EPA is an uninhibited executive branch agency able to legislate. The EPA and ATF need to go, and set up appropriate agencies to review and recommend to the legislators...or just go.
Yes, this article was almost next to the other one I found. This man has done nothing that the EPA should have any involvement in, and here is the real problem with them: Their ability to adjudicate and levy fines. They should be like any other part of government and have to file a complaint with a court, and deem the person in violation, then the judge levies the fines or whatever is needed. That is where the whole system breaks down, and now you have an agency that is unaccountable, and can be used as a tool of the administration. We had e coli going off the next door property in huge amounts and the EPA was not interested, and let the State be their minions, who fined the idiot after 3 years 900.00. Whats the difference?
There may be some "technicalities," but, yep, if an individual, under color or law (I work for the government and am here to help you) violates a right (due process: Andy was never heard before the imposition of the fines), he is INDIVIDUALLY liable.
It may be irrelevant the FACT that this man followed all know regulations the situation is now winding up in a court and the court will determine the outcome. And some still think the usa is a free country.
Who is going to levy a fine in the "You scratch my back and I'll scratch yours" environment of Washington? To date, all I've seen of the executive, legislative and judicial so-called branches of government is that they act like a single large family that has a few interior squabbles, but nothing is ever done to change things in a substantive manner. Come to think of it, they act like a Royal Family, at that.

The problem with the levying of fine on the EPA is that it is taxpayer that will be paying those fines. Unless a system is put in place so the fines come from their operating budget and/or the personal accounts of those that manage the Dept.
