    One thing is certain; the Arizona state legislatures deserve our respect! They have been actively battling the federal government to assert their 10th Amendment rights ever since Janet Napolitano ended her term as governor! Hooray to Arizona! This is reminiscent of the peaceful marches of MLK Jr. which garnered support of the masses because it revealed the abusive powers of government.

    The Feds already break the law though, so what will stop them from just doing it to some more laws?

      This gives Sheriffs the legal authority to arrest the feds
      "Any federal employee violating the law would be subject to prosecution on the following grounds:

      1. Kidnapping, if an arrest or attempted arrest occurs.

      2. Trespass, if a search or attempted search occurs.

      3. Theft, if a seizure or attempted seizure occurs.

      4. An applicable homicide offense, if loss of life occurs.

      5. Any other applicable criminal offense prescribed in title 13."

          Umm, this is only a political stunt, it's in conflict with Article 6, Clause 2. By being admitted to the United States of America, Arizona conceded to the US Federal Constitution.

          Arizona could arrest a federal agent for example, but the state judge could never uphold the arrest or issue a warrant for the same, if the agent is acting in accordance with their duties and under federal statutes. Keep in mind, that there really isn't many federal statutes from a criminal perspective - I think most stem from the war on drugs, etc.

          Establishes the United States Constitution, federal statutes, and treaties as "the supreme law of the land." It provides that these are the highest form of law in the United States legal system, and mandates that all state judges must follow federal law when a conflict arises between federal law and either a state constitution or state law of any state.

          It doesn't really change anything anyway, County Sheriffs are always the highest law enforcement officer in the county, that has always been the case.

    This is really going to wig out the federal LEO's, who already have an unabashed dislike for people who are constitution-abiding and believe in the rights granted by the constitution... that doesn't give supreme power to the Federal Government. Worse, they work very hard to link all constitution-following conservatives into the "militia/posse Comitatus" lone wolf nutballs.

    Example? They look at the Gadsden flag as the banner of the enemy. Serious beans - if you don't knuckle under to the mighty authority of the dotgov, you are the enemy - or to quote one former president - "If you're not with us, you're against us".

      Then AZ needs to push the issue. 1st of all it is not the same as the immigration law, because there is no argument that this has to do with foreign affairs. Second of all the Constitution never said the the Supreme Court gets to be the final arbiter of what is constitutional. AZ needs to stands its ground.

      The Supremacy clause only applies to valid acts by the Federal Government The Federal Government does not have any valid law enforcement activities, only military.

        dbhalling is correct for the most part. The Supremacy Clause indeed applies to federal matters - IF pursuant to the Federal Constitution. That is, the enumerated powers - the valid areas of action for the federal government. 9th and 10th specifically leaves to the States everything else not enumerated to the feds. dbhalling is correct on law enforcement. That is a local function within the States. Territories are another matter, however. But that is not the point with this Arizona effort.

      Yes the constitution is, however, the States have the rights to deport, and perform many, many things the Feds do. The FEDS MUST also Obey state laws since states are Sovereign. We do not live in a Democracy, We do not live in a dictatorship, although that is disputable with BHO in office, we live in a Representative Republic whereby the Feds get their power by the consent of the states and the people.

      Though not a legal scholar, this bill appears to me to be nothing more than an assertion of the Tenth Amendment: that EVERYTHING not specifically designated to the Federal Government remains in the hands of the States.

      Really, what this asserts is that Federal Agents' authority is inferior to the authority of that of authorized Arizona peacekeepers and that Federal Agents must bow to that authority unless the Federal Agents can make a _specific_ case for individual actions. They have to justify all their actions based on legitimate Federal oversight in order to ignore this law in a court of law.

      The reality of this is that this is a win-win for Arizona because it will force Federal Agents to work with and respect Arizona law enforcement instead of high-handedly ignoring them as they have been doing all during Obama's tenure.

    I have lived in AZ for 15 years and live near a retired ATF agent. A year or so ago, we got into a discussion about the federal officers and the fact that I feel they have no jurisdiction, without being asked. He pointed me at A.R.S. code 13-3875 and explained that basically any Fed can apply to be an Arizona Peace Officer.

    So, the key phrase in the legislation is, "A federal employee who is not certified as a peace officer in this state pursuant to section 13-3875 may not...". The only way this legislation would work is if Arizona Sheriffs stopped certifying feds as Peace Officers.

    Given the sort of “government” now operating in the USA, ‘twould seem that the most likely scenario, if folks in AZ attempt to effectively act on this bill would be that anyone actively involved would be audited & harassed by the IRS & a bunch of other federal agencies &/or perhaps family members of sheriff Joe or others might accidently disappear or become dead or injured.

    We live in interesting times.
