So first of all, the "contract" is bogus. I'd have a lawyer point that out to these stupid administrators. First, the contractee has no comprehension (due to age) of what they are signing and she is signing under duress - either of which are strong defenses in a court of law.

From a practical standpoint, however, these teachers really need to take a gun education class. If it doesn't have the parts necessary to BE a gun, IT DOESN'T MATTER. It's called "imagination" - though I know liberals are terrified of a child wielding the power of the mind.

Probably because the school's administration is trying to cover ANY and ALL future incidents where ANY student hurts or kills themselves or someone else on site... so that the SCHOOL IS NOT HELD RESPONSIBLE... which, in itself, is rooted in the current 'morality' of "no matter what happens, sue EVERYONE!"

It's psychological mumbo-jumbo out of the substance abuse treatment into the mental health treatment and filtering down into social work and teachers, all of whom see themselves as social engineers working for the good of us all. Teachers seem to have no reasoning power or common sense. They overreact repeated. When our daughter was in grade school, she wore her 007 shirt to school, and was told to turn it inside out all day, as she was "endangering" other kids with the gun in Bond's hand! Now, is that even rational! Even a 9 year old knows that is ridiculous. They had some bizarre teacher practicing Maslow group therapy in the classroom of 9 year olds, and drove one boy to attempt suicide after a session. In my opinion, she needed psychiatric help.
Now it is crayon pseudo guns, really? Teachers have to be the most scared people on the planet, that is what being liberal will do for you. When one boy threatened to set a bomb off in the school, the teachers ran and locked themselves in the classrooms. He had no bomb, he was just pissed at his teacher. Meanwhile, while cops swarmed the school, some kids were stuck in the hall, one boy tried to push our daughter down the stairs.She used her Tae Kwan Do training to flip him and send him sailing down the hall on his backside. Then a cop showed up, and wisely said, "He won't try that again with the wrong girl." Luckily, it was not a teacher, or she would have been suspended for defending herself - which is also a no no in schools..

In law don't they say the exception proves the rule. If a sign says no parking Sundays, it implies parking is allowed on other days. So if the school enters an agreement with one person not to commit murder, does that mean students who didn't sign the contract can't be liable in a wrongful death civil suit b/c they never promised not to murder?

I started thinking what could make this contract legal. Suppose they made with the parent, who has legal capacity. They'd have to offer her something reasonably consistent for the going rate for not encouraging a 5 y/o to commit suicide or murder. There's not really a market rate for that, unless we look to underworld hit contracts and figure non-hit contracts are about the same value.

Even if there were, wouldn't it be an invalid contract b/c it involves something illegal? A contract to commit murder would be unenforceable. Wouldn't a contract NOT to commit murder be similarly unenforceable? Such a contract would put the court in the position of making the other party (the school district) whole if the kid did commit murder or suicide. It would also be an odd situation if the parent came in and said she'd like to buy out of the contract not to commit murders.

This is just silly. They know it too. That's why they won't return Modupe Idowu's calls.

They do not yet take the children away at some age and have them sleep and eat there as well. Thus they are not camps. Perhaps all we will see are the day camps that are all ready in place. I hope so it leaves us with another choice.

EDIT: and perhaps more importantly with the ability to talk to our kids about the crap they are "educated" with and help them understand completely what is being attempted and how to combat it within their own minds. Even if your kids are in public schools you have the ability to counteract the garbage if you as a parent will do so. At some point they will attempt to take that ability away.

The more I hear about the public school system, the more grateful I am that I was home-schooled.

Personally I see a much larger issue. There some basic tenants in this country that all stem back to basic contract law and civil Liberties.

Agreement: One party must offer to enter into an agreement, and the other party must accept the terms of the offer
Consideration: Something of value received or promised, to convince a party to agree to the deal;
Contractual Capacity/ competent parties: Both parties must be competent to enter into the agreement;
Legality: The contract's purpose must be to accomplish some goal that is legal and not against public policy;
Genuineness of Assent (Arguably part of agreement): The apparent consent of both parties must be genuine; and
Form: The agreement must be in whatever form (e.g., written, under seal, etc.) the law requires.

Mental illness can start at a young age, if the rest of the story is that she's acting pretty bizarre or antisocial, 1 in 4 Americans have a diagnosable mental illness, it's not a stretch. I'm sure Eric Kliebold's parents might have reconsidered their heads in the sand approach or the moronic mom in Sandy Hook that thought spending quality time at the shooting range with her autistic kid that only was interested in first person shooters may have rethought that too if she could.

Pretty bizarre story though, just hope mom doesn't ignore a problem as she gets older out of stigma... Mental illness is usually treatable, no reason any of those events should happen. Always seems to trace to a lack of intervention by the parents, as odd as it sounds, it's probably a misguided self defense mechanism by the school. If the girl does have issues, private school is one of the worst options, they don't have the special ed she will need if she grows up on meds.
