The real question - as pointed out by the article - is that they try to claim the privileges of being a service provider while also trying to monitor and police their content. They have to choose either one or the other.
Yes, that seems to be their fallback position, a package deal if you will. They are pragmatists, without principles, and don't know anything about objective rights.
