What makes this case especially surprising is that it happened in New York. If it was Texas or Mississippi, that at least would be understandable (though it wouldn't justify it).

But regardless, this could set a very bad precedent if the woman loses the custody battle because of this.

      This story has a double edged sword: You could also talk about the court using Catholic tenet in making the decision!

          Custody laws take in a account children’s religious upbringing. Courts don’t like to have to give custody to one parent over the other, but sometimes the parents simply can not get along. The judge has to look at things beyond economics and housing. The story states the mother was suing for custody and using mental distress as an argument. The abortion, the rest of it, is just a counter-punch by his divorce lawyer. If his lawyer didn’t do this he wouldn’t be much of a lawyer. Custody cases can be real ugly; they are fighting for control over the children so they can kick the ex-sponse out of their life. There is no ‘big picture’ here.

    that the judge is allowing this baffles me. it is not relevant to ability as a mother. family law has been off the charts for over a decade now.

        "kill your kid" well, we do not agree on definitions, and so, I will answer the mother in this case has not been proven to intend harm to her children (with what info we have) and so therefore this information is inadmissible. I do not like that family law gets into the most intimate details of an individual's life. It is wrong and ineffective and bitter custody battles should not be indulged. some parents are jerks but to say that the state will only make determinations in divorce custody and not for every other parent (which I also would not advocate for) is irrational.
