EEOC decides that Employers don't get to set their own policies
This is an overreach by government, plain and simple. Employees don't have a "right" to speak in another language when on the job. They do have the right to quit and go find another job. Employers have the right (or should) to set policies they see as being in the interest of their business. If one of them is telling their employees to speak the common language during work hours, I don't see the problem with that.
