Breaking up the Ninth Circuit Court

To me, the ideology of the court is a secondary matter. The primary one is that there are eleven courts, so each should represent about 9% of the people in order to carry on its business. With 20%, the Ninth Circuit needs to be split.

    Breaking up this crop of liberal leftists is critical and long overdue. Arizona falls under their jurisdiction and I've watched for years as they've repeatedly ruled against pro-American policies (Az SB1070 most notably) and the Constitution in favor of an anti-American agenda.

    What they've done now is par for the course for the 9th circus.

    Adding a court to reflect the demographics today makes sense. How about a quality control mechanism. Every year the court's record of review should be scrutinized. If a judge has been on the "wrong side" (using the Supreme Court as the arbiter or the "right side") more than 50% of the time s/he should be removed from the court and replaced. As the Ninth is overturned 80+ per cent of the time, the court would quickly be replaced with judges more in line with the Supreme Court and the Constitution (whether SCOTUS and the Constitution are in line with one another is another question -- which hopefully will be answered and remedied in the near (Trump) term)

      Imaging you are a construction contractor. You fix leaking roofs, build decks, add skylights, run some electrical wires, and do dozens of other related tasks. Imagine that you do 80% of your work wrong, and somebody else has to redo it right.
      What sort of no-integrity low-life would you have to be to keep taking money for that kind of atrocious performance when you should simply resign. But it’s okay. You’re just a schmuck with a hammer and some nails. It's not like your work affects the lives of millions or degrades national security. That high-impact kind of work absolutely requires persons of the highest integrity and exemplary judgment.

      How can the Ninth Circuit Pond Scum look at themselves in the mirror without throwing up?.

    Breaking up the 9th Circus Court of Appeals wouldn't have made any difference to the fate of Trump's Executive Order on immigration. The Dimocrats would have found a liberal judge in the region where the 9th Circus has jurisdiction, and made their play there. The whole thing was planned by the Dimocrats all the way, and they got the better of Trump in this case. But Trump will be back with a better Executive Order as he learns to play the game to beat entrenched establishment elites.

    Breaking up the 9th Circus may be a good starting point, but maybe a Constitutional remedy is available? The 9th Circus is reversed by the Supreme Court about 80% of the time, so maybe a smart Constitutional attorney can figure out how to impeach judges that obviously aren't trying to apply existing law.

      Impeachment is in the Constitution, but to my knowledge it has never been used against a judge - either Federal Appellate or Supreme Court. Given the partisanship which exists in the Senate, there's no way we would get a Conviction short of the individual murdering someone. And that's a sad commentary on the true power left in our Legislature - which traditionally should be the most powerful branch of Government.

    whether you split it or not...the area still represents a philosophy that is anti-liberty, anti-freedom, anti-reason, and anti-republic...you just get two courts that mirror one another...

      Not necessarily. The Ninth Circuit also includes Western States such as Idaho, Nevada, Montana, and Arizona, which are far less progressive than California, Oregon, and Washington - where the proposed split would occur. Assuming that judges are selected from their jurisdiction, we would have a very different ideology among judges.

        good point...i remain hopefull...my trips in Arizona had nothing but Trump bumper stickers, but the minute i crossed into California...Saunders and Hillary stickers...

    That the Ninth Circuit has 20 percent of the population, certainly gives grounds to split it down the middle and create a new circuit taking half the population of the old. But the real problem is the rules of Senate courtesy. The Ninth is dominated by leftist appellate judges because leftist Senators predominate in that Circuit and have for decades. The new Twelfth Circuit would have conservatives predominating in its Senate delegation.

      I don't care if they break it up or not but the rulings coming out of this leftist court should only apply to the leftist idiots who elect them.

        That's what the Supreme Court is there for--to resolve splits among the circuits. Create a new Twelfth and you have yet another circuit that can yield decisions contrary to those of the Ninth.

        But of course what indeed does that say of the electorates for those Senators? We might indeed serve ourselves better by letting the "Left Coast"--except for that proposed State of Jefferson--form their own country.

    The Constitution gives federal judges lifetime tenure unless impeached. But if the 9th circuit is split, I assume judges now on it would either stay there or move to the new 12th circuit, based on where they live. If Trump and Congress handle the split skillfully, this could result in new judges having a majority in BOTH circuits.

    FWIW, here are some federal judges whose impeachment was considered in Congress. It happened, but not very often.

    I would vote for breaking up the union into two parts. One part which likes and honors the original constitution, and the other which is socialist. Let the residents move around to select where they wanted to live.

      The south tried that but the corporate looters in the north wouldn't let the ones they wanted to enslave (with high protective tariffs that stole from the southern farmers and merchants to benefit northern manufacturing) get away. With looters some things never change.

        I feel like a modern day slave actually. With the reaction to Trump going full blast from the establishment, I am losing trust that socialism and cronyism can even be slowed down at this point, let alone stopped.

    It appears that they want to shrink the jurisdiction, not break up the court. Depending on what is appointed to a new one we could wind up with two circuses.

      Potato, puhtahto. They want to create two separate jurisdictions. If they did that, justice selection would necessarily occur to fill the new slots. If I am correct, justices are appointed from their respective jurisdictions, which would mean that ideologically we would have a very different court than the current Ninth Circuit as California, Oregon, and Washington are much more liberal/progressive than Idaho, Utah, Nevada, et al.

        If Trump were to successfully appoint proper judges to a new jurisdiction it would diminish the scope of influence of the leftist judges like those in the 9th circus regardless of where the new ones would come from, or we could wind up with the new Trump Circus clone. But whatever improvement might happen would be a short term gain because of the intellectual trends nationwide in the opposite direction. Take what you can get, but don't stop fighting to correct the intellectual trends over time. That isn't about who is a judge in a certain district right now.

        Meanwhile, we are talking about the size of the jurisdiction while the 9th circus has just decreed itself to speak for the whole country in making foreign policy, and despite their losing in the Boston court.
