Apple could have withheld capability, and is therefore, responsible for user's actions.

Freedom = responsibility. They must go hand in hand. No other approach is consistent. If individuals can not be responsible, their freedom must be taken away. The converse (I do not support either) is that people in general can only have the freedoms that the lowest common denominator can be held responsible for.
