The 9th and 10th Amendments prove that any federal power must be explicitly spelt out.

I have not found anything in the Constitution that gives the federal government any power to restrict immigration. (They do have the power to determine who gets naturalized citizenship, but that's a separate issue.)

That is the point, though. Nullification is constitutional on acts of any branch of the federal government that have no explicit authority.

As to when a branch of the feds fails to properly exercise its enumerated duty, such as immigration, the States do need to act.

Since everyone here seems to think that a Constitutional Convention would not solve the problems with the government and Congress the only thing left is the following: "God forbid we should ever be twenty years without such a rebellion.
The people cannot be all, and always, well informed. The part which is
wrong will be discontented, in proportion to the importance of the facts
they misconceive. If they remain quiet under such misconceptions,
it is lethargy, the forerunner of death to the public liberty. ...
And what country can preserve its liberties, if its rulers are not
warned from time to time, that this people preserve the spirit of
resistance? Let them take arms. The remedy is to set them right as
to the facts, pardon and pacify them. What signify a few lives lost
in a century or two? The tree of liberty must be refreshed from
time to time, with the blood of patriots and tyrants.
    It is its natural manure."
We will have to go back to Thomas Jefferson Statement and that the apathetic American citizen will have to be dragged kicking and screaming into a armed revolution.

I am worried about such a convention because the people largely have less understanding of freedom and of the proper role of government than they ever in our country's history. I don't see it is going to be easy to get through that to more freedom supporting results.

There is no reason to not go this route. While it remains open. One thing about leaving the Constitution for the Patriot Act Crap it automatically nullifies all Constitutional possibilities including Article Five.

Get George :Lakoffs book about Don't see the Elephant. Read carefully laughing when needed then follow the same path and that's how you get at the mindless mush of the country. It's how lakoff separates them from $10 for each of the ten plus books and he's only a plagiarist. no original thoughts just a one man secular 700 club. But it works for that group of mush minds.

The idea of some sort of Constitional convention is a bad idea because it opens the genie in the bottle with no way to it back. As to who represnts the States is another problem. The idea was originally the the House represented the People, the Senate the various States. Progressivism subtley got an amendment passed to strip the States of their power.

That's its purpose anyway. Which means we've got to somehow prevent the Usual Suspects from choosing the delegates or writing the agenda.

Nullification is unconstitutional, unless it can be shown that Congress wasn't abiding by the Constitution when it did the action being nullified.

It will certainly be in order for the states to convene a convention themselves if Congress doesn't act once calls for one come in from 34 states.

Remember the key feature of an Article Five Convention: new faces. New voices. The new boss will definitely not be anything like the old boss. That's how this will work.

    He does give one hope.
So far, the current government has trashed the Constitution. What's to keep it from doing the same with the now government, whoever they are? I don't know if there's a strait jacket big enough to fit the Hulk. Which is what the government has become.

I do. That's why I'm stocking up on ammo and will likely buy a couple more guns.
One will be a revolver. Why not? I've three speed loaders laying around from my Alabama Department of Corrections days.
I've also set aside for contemplation a crossbow in a mail order catalog.

The US Constitution was written to protect citizens against an oppressive gov't. Period. I think the provision for Convention of States is great! I hope the young people of this country take the bull by the horns and use this to save our country and dissolve the Federal Gov't.
