This sort of begs the question, who owns the rain? I should think if it falls on my property, it is mine to do with as I wish, but then....

        It's their law apparently not our claim. Oregon does the same thing.

          Can you provide me some reference? The State told us in our laewsuit that each property owner is responsible for their runoff and can divert or use it any way, so you have to sue them individually. I could not find any reference in ORS.

            I'm referring you to the previous poster. ha ha that's you. In Oregon they declared themselves the lords of any water or water source that is geo-hydrologically contiguous to any water body or any part of any water body a portion of which has been declared wild and scenic. The main watersheds and riverine systems in the state all flow off the slopes of Crater Lake. Deschutes, Willamette, Umpqua, Rogue/Illinois and Klamath. To the North and Northeast the Snake Columbia system. We found that out when a long time resident and ha ha property owner attempted to replace a small one boat dock on the Rogue. They also, at first asked, those of us who lived in the country to put in water meters and help by sending in monthly reports. Later made it mandatory readings by officials with trespass rights. What they didn't know and what made the land so valuable was a second well hidden in the basement. Most house didn't have such a feature. Why? The meter readers ended up with water billings.Gradually life in the State of Oregon became untenable as the Land Dictators and Commisars Commission sunk their claws into all property. It had another name but that one is more accurate. Better to move where the stench of fascism was not so all pervading.

            In your case that's how it starts. but it's a disease that spreads.

                I seem to recall a questionnaire about source of household water. Wells, City or Water District, delivered or purchased, etc. They didn't leave space for more than one ....Naturally we didn't mention the second artesian. The valves were set 1/3 and 2/3rds. The buyer put in a swimming pool. His stance was God provided the pool water much as he floated Noah's Boat.

                  Seems like he had the right idea. Artesian is good, if it never gets any iron bacteria, we have it in our well from the cold iron pipes they used and it is a pain, have to chlorinate every 3 months or so just to keep it from clouding up in the horse buckets, and it makes tubs turn brown. Learned that Barkeepers Friend is the ultimate cleanser powder, removes all that stuff in a heartbeat, cleans copper and will clean up a nasty fry pan in a couple minutes.

                    It was an accidental find. the two wells all part of the same substrata. The original builder/owner dug out a basement and thinking about it brought in a small well driller rig. The house was build on a slope with three areas bulldozed flat and the second shelf with a big slot for the basement. The water was struck at 50' or so additional as I remember. Capped and then three sides of the basement walls and the floor poured and sealed. with an added just in case drain out the fourth side and the septic etc. systems and fields put in place. Fourth wall built and the supports for the ground floor of the house itself and steps AND the base of a heating system - wood fired - The basement level was built as a smoke house.So the rest of the slot filled in and house construction (two story) added. Ground floor had a central fire place with wood stove off the back side in the kitchen area. We were on 150 acres and plenty of wood to burn. The builder put in air ducts from the brick chimney area as it passed through the second floor and that heated the next level. Learn to bank a fire properly and it worked quite well we ran about three to four cords a year. The other well was an after thought and meant for watering the barn and the garden. Quite innovative for it's day. He had paneled the second floor ceiling just under the roofing so the heat would hasten any snow melting. ran the water pipes up under the roof as well.That warmed the roof top area as well and in the summer it preheated the water something half a century or more ahead of it's time.It's been modernized since then but the system made it easy for the owners that followed my family to accomplish. They added solar.

                    The builder told us about houses in the 'old country' meaning Europe that followed the same plan for the same reason as today. energy efficiency.
