Court: School Can Ban U.S. Flag Shirts for Safety

William Becker, one of the lawyers representing the students, said he plans to ask a special 11-judge panel of the appeals court to rehear the case. Becker said he would appeal to the U.S. Supreme Court if he loses again.

"The 9th Circuit upheld the rights of Mexican students celebrating a holiday of another country over U.S. student proudly supporting this country," Becker said.

Cinco de Mayo marks the Battle of Puebla on May 5, 1862, when Mexican troops defeated a French army of Napoleon III, then considered the mightiest military in the world. It is considered a bigger holiday in the U.S., celebrating Mexican heritage with parades and revelry in many major cities.

Now I wonder why they couldn't send the Latinos home? Instead they choose to criticize the American student in his own country.

Did anyone wear a French Tricolor? The problem is not just that American kids were banned from wearing an American flag in a public school in America, ironic as that is. What if someone wore a Swedish flag and ethnic Poles objected? There'a wider issue here.

Does the school still fly the US Flag outside its building on May 5th ? If so, what message does that send and will that be next ?

Sorta screwed up, isn't it? It's like they wouldn't want to insult the poor Mexican kid, who has no problem celebrating Cinco deMayo in THIS country.
