Agency cited for overreach in Pelletier case

We are finally seeing significant movement in Justina Pelletier’s favor after the Massachusetts Department of Children and Families (DCF) conspired with physicians at Boston Children’s Hospital to make her a “ward of the state” more than a year ago.

A DCF spokesman revealed in an interview with the Boston Globe this morning that the agency is dropping contempt of court charges against Lou Pelletier, Justina’s father! According to the Globe, the charges are being dropped after “First Amendment lawyers criticized the far-reaching nature of the judge’s gag order”!

This victory was due, in part, to the magnificent support Liberty Counsel’s many friends gave to get our legal team on the scene and deeply involved. I also understand we are close to seeing Justina’s access to quality medical attention restored! Thank you for all you do to make us able to respond to emergency situations like this one.

More than a dozen Massachusetts State Legislators blasted the Department of Children and Families (DCF) for “breaking up” the Pelletier family and decried the ill-advised imprisonment of Justina Pelletier.

They are now calling for the House Committee on Post Audit and Oversight to launch a full-scale investigation into the DCF's handling of the case.

++This is “truly shocking” and a “gigantic overreach.”

As reported this morning by the Lowell Sun, a suburban Boston newspaper…

The group of 16 legislators (and growing) is “led by Republican Reps. Marc Lombardo of Billerica and Jim Lyons of Andover…”

Representative Lyons called the situation “incredible”…

“Just picture a mother and a father at home who decide that they have to take their child to the hospital for flu-like symptoms… And then within three or four days that child was taken away from them. That's just an incredible situation when you think about it.”

Lombardo called the DCF's actions “truly shocking” and “a gigantic overreach.” He said his research into the case showed the Pelletiers acted in good faith, following the advice of Tufts Medical Center doctors.

“As the parent of young children, it's truly heartbreaking to see what DCF is doing to the Pelletier family… I believe the state has a very defined purpose of stepping in – in case of neglect, abuses, or malicious intent – where there's a failure to be able to care for the child. None of these things are present here.”

Lombardo said the representatives plan to introduce a resolution entitled “Acknowledging Serious Concerns regarding DCF's handling of the Justina Pelletier Case” in the House's next formal session on Wednesday.

The resolution says, in part, that because Justina's parents have “provided a loving home” and there are “serious concerns” over the process that led to the breaking up of this family, that DCF should “immediately release Justina Pelletier from their custody and reunite her with her parents.”

Next Wednesday, as the Massachusetts state legislators introduce their resolution, we will deliver our End the Pelletier Nightmare petition to the two sponsors of the measure – and to the governors of Massachusetts and Connecticut.

While this battle unfolds in the legislatures and courts, Liberty Counsel will remain engaged as much as possible to see that Justina is returned to her home and family – and once again begins receiving the medical treatment she needs.

Joe, quite honestly, this could be any parents’ or grandparents’ nightmare.

The idea of a medical facility removing a child from a loving family – a family in which there is no history or evidence of abuse of any kind – is a chilling thought.

The idea that physicians there have coined the phrase “parent-ectomy” to describe the process of ripping a child away from their home and family is egregious abuse by Big Brother.

The Pelletiers never saw this coming when they took Justina to Boston Children’s Hospital at the advice of their primary physicians.

We are exhausting all legal means to get this done in a timely manner before Justina’s health deteriorates any further.

    Update on the Pelletier case - Contempt of court charges against Mr. Pelletier have been dropped. Justina still in custody of DCF. Watch The Kelly Files tonight on Fox News at 9:30 pm.
