Caution: rude words, politically incorrect ideas.

Original thinking- No, that sort thing has been done before, eg a refrigerator manufacturer used an internal chip programmed to get top results in a consumer org test.
Pollution- has been 'quantified' as the same a taking a fart outside, so not very serious in a technical sense.
What they did- When test conditions were detected, adjust to run at lower emissions, higher fuel consumption and lower power.
Fraud or error? Almost certainly deliberate so fraud.
Size of penalty- Expect gianormous. Undercover trade protection policy at work.

They deserve a commendation for original thinking, and to pay for the costs of repiratory issues the emissions cause.

I am not saying I know that VW just screwed up, but don't cars have more of a problem with emissions when the engine is idling.

I can so see the embedded systems guys only getting it half right.

There is an old Heinlein quote that goes something like "Never ascribe evil intent to that which can be explained by simple human stupidity."

I agree. It's usually stupidity rather than machinations.

I do electromagnetic emissions testing all the time, and I see how it can be unclear. Sometimes you have to write a program that exercises all the common use cases. It's a judgment call how much effort you put into doing things that might make your product fail emissions. Most EEs who do this type of thing have spent a day or two in a certified lab trying one mod after another trying to get their stuff to pass emissions.
