Because the EPA has the biggest stick. They have amassed so much regulatory power, they are damn near invulnerable to outside influence. With the eco-crazies in charge, it's no wonder they are doing what they are doing. Read "Agenda 21" for a glimpse of a scary possible future.
The EPA is seriously overstepping here, but at the same time the Wyoming governor is being a wimp about it. Let’s say I was the governor of WY. My response would have looked a bit like this.
“The boarders of the state of Wyoming are legally and historically established. We are willing to speak with the Northern Arapaho and Eastern Shoshone Tribes to address any concerns they have, but the EPA has no authority to change our boarders, so their ruling is irrelevant. My word to the people of this great state is that our boarders will not be altered by a ruling from the EPA. If the EPA does not reconsider its ruling I will activate the Wyoming National Guard and the civilian militia, being composed of all willing to serve, to defend our boarders from federal incursion.”
The external state boundaries have not been altered, rather a reservation has been expanded and what was state land has been given over to an Indian tribe.
I don't think there _is_ a Constitutional process for altering state boundaries. Definitely not without the consent of the states involved. Given that new states can be admitted and existing states divided, I suppose that if the two states agreed (via some state-level process) then the federal government could approve the state resolutions, sort of like approving a treaty.
This is not something that can be done without the consent of the states involved, and definitely requires at least a law (1/2+1 HR, 1/2+1 Senate, President). An executive department can't do it unilaterally.
