    It still bothers me that before a challenge to an action impinging on individual (Constitutional) rights require differing opinions or findings in lower courts before the US Supremes will look at it.

    What good does it do the country, in the case of violations of individual rights, for such an impediment to resolving such a basic issue. That condition, more than almost anything else, has been the major factor allowing incrementalism to piece by piece, dismantle the individual rights of the citizens.
