Why is this not all over national news? All of these judges recused from the case! The Justice Dept lied to EVERY judge therefore they are directly involved in the case.

    It surprises me that people are shocked when these things are uncovered. Our legal system, as so many of our institution, has been corrupted, both from within and without. IMO

      I hate to say it , but nothing shocks me any more. Sickens, enrages, disapoints, but these types of activites seem to be the norm for our entire gov. these days.

    I've been involved in a couple of Federal Grand Jury cases, and can verify they're nothing but kangaroo courts used to promote the careers of prosecutors and justices. I was pressured to perjure myself, and when I refused, charged with being an "unindicted co-conspirator". That charge was only dropped after I threatened to disobey the non-disclosure order and go directly to the Washington Post with the story. Since my personal record is absolutely crystal clear, the judge decided she couldn't risk my credibility causing them trouble.

      The "legal" system I'm involved in at present has allowed my opponent to claim....
      "I have a patent"....he does not
      "I have a trade secret".....he does not
      "I have a trademark"...he does not
      We've asked my opponent to disclose any documents or notes...he has not
      The counter-suit is now at "Breach of contract and Replevin"
      The case is more complex than this simple example. However; the "Court" has allowed my opponent an avenue to obfuscate the issue at every corner. The only redeeming aspect is the order to allow a new deposition of "him".
      The only "winners" seem to be the lawyers, stripping both of "us" of earned wealth.
      I estimate "justice" would have been served within two days of myself and my opponent sitting in front of a judge with our respective evidence and testimonies.

    The Judicial System exists for the purpose of: a) Protection from force and fraud AND b) Prosecution of those who engage in force and fraud.

    When the Justice System is used for perversion of the law and persecution of the citizens then it has become the primary criminal element in our lives.

    It gets more personal for me... SPI is a local company for us, and they own or have rights to most of the land up here. They just went through an adjacent parcel to ours, and thinned it (and did a damned nice job IMO)... I spoke to one of their people and they said it was because of the Ponderosa fire, the potential of lawsuits from the local homeowners, and other issues he couldn't discuss"...

    $5Au's guess is the reason the Feds conspired to railroad Sierra was that they want to placate their environmentalist friends by taking 22,000 acres out of timber production. This Judge England has a pair of big, brass (maybe gold) ones!

    It is a good sign that the judge in CA was willing to act.

    I don't know fully understand the motivation for the corruption. Sierra says DoJ wants to recover the fire fighting costs. They're going after Sierra, Sierra says, b/c a) they didn't contribute to anyone politically connected to DoJ, b) they have deep pockets, and c) they could plausibly be framed for it. Why do DoJ employees care about recovering some costs of fighting fire? Usually the Fed gov't has the mindset of it being _only_ 55 million dollars at stake. It's hard to imagine the employees would be willing to risk their reputations to pull this off.

    I'm open to the idea, though, that their prosecutorial power went to their head, and they felt like they were above the law.

      it's somewhat the same scenario for Gibson Guitars. Once one agency gets involved they all tag team and gang up. The prosecutor in The GG case said-we will win no matter what. and GG settled without ever even being charged. Frankly I see it as a pure power grab. It serves to tell every other business and private citizen we are here to control you. You work for us, not the other way around.
      13 federal judges recused. People need to go to jail if this is proven in court. and what about the kickback to the fire investigators? that's a pretty big smoking gun...

        I have heard that Gibson has had their materials returned and the settlement returned.
        This makes two cases against the DOJ which did not go the way they wanted it to. Good.

            I posted my debacle up the line to dbhalling.
            The proceedings mentioned have caused me to miss a financial peak in business, combined with the diversion of funds toward legal representation, combined with the interference of a substantive single contract by my opponent, of which all were going to be allocated to expansion of a specialty repairables business in the N.D. oil fields. I've lost market by not being the first in the area...est. gross profit of over 250K.

            The good part was that Holder and his DOJ thugs got overturned in this case. Might make them a little hesitant to act impetuously based on politics the next time. Probably not, but its a thought. This administration does not seem to learn from their mistakes. Now that you have brought my attention to the losses incurred by Gibson in just fighting this debacle, I can only imagine. Whew.
