The elites have no need to 'legalize' it. They are free to practice it already. If someone threatens to expose them, a convenient "suicide" can be arranged.

It was designed with only property owners allowed to vote. When that went away, the new voters with no "skin in the game" were free to vote themselves bread and circuses.

There is no such thing as Red and Blue states. Look at the entire US map and tell us what color you see in over 95% of it and then bring up the maps of each individual state and it's a wonder how the blue even survives. The few states that do appear mostly blue usually have more votes counted than they have registered legal voters.
