I realize this will rile some up, but I am with Captain Sulu on this one. The state has no place dictating to any business that it can discriminate or not discriminate based on anything. Business should be seperate and free from state burdens regarding social issues, and the natural result will be they will either succeed or fail.

    What are the "rights" here that government claims to defend, and are they really rights or should government leave people alone and let the free market decide?

    I agree insofar as the state has no business telling me what I as a business must or must not do with respect to my business practices vis-a-vis to whom I chose to do business with. It's a moral stand, as well as a practical one. For example, I have a VERY fast vintage muscle car. Let's assume that I decide to sell it. Let's further assume that some 19 year old goober whom I know to be a drunk (or drug abuser if you prefer) shows up on my door step with cash in hand. Do I have the right to refuse to sell it to him, or will I face prosecution for age discrimination?

    It's a VERY slippery slope at best.

      In my view, you have every right to NOT sell it. I do think businesses have the right to not do business, but have to face the consequences (such as the boycott Takei proposes). I do not see a rational business owner turning down business because of gay, straight, whatever, or black, white. It goes against every idea I have of business, which is "to do business". Any business that practices discrimination is going to not last long, as those customers will go to those that do. Forcing someone to do something they do not want to will just get you a crap job. Skip that and go find someone who will do what they are hired to do.

        The boycott of which you speak is the other side of the coin. Practically speaking, it's a can of worms that I think would be a serious mistake to open. What of the bartender who obeys the law not to serve a drunk, but the 'drunk' turns out to be sober with speech impediment? What of the atheist who goes into iTunes and sees that they also carry religious movies and music? What of the physically impaired who wants to buy a dump truck?

        I can see courts tied up for years if not decades, all because populist legislators abandon common sense in order to curry favor with the masses.

    But the bill will say that a business CAN choose with whom they will do business. I think that is the right stance. Takei does not want a business to have the right to choose, so I am not on his side in this. Don't get me wrong; I don't think there is a need for a law; it should be obvious that a business is free to choose.
