The Judge is, as usual completely correct. The problem that many people have with freedom is that it forces one to often make very difficult decisions, and that's where "balance" comes in. But Judge N. rightly points out, that balance means to take away from one part in order to balance it with another part. What part of freedom do we take away?
I agree with all the judge said. That would include that are Constitutional rights cannot be taken away by a majority vote. Here I quibble. Despite what the Constitution states, there may come a day when some charismatic leader whips up a majority to vote in such away. I don't think we're at all far from having enough supreme court judges who would just roll over and play dead.
When the populace has a religious feel, why should one be surprised. US Politicians are a kind of clergy that have there own language that the Lessers cannot understand. Call it 'FED Speak'.
But it seems that the Judge is a voice in the wilderness--and we lose. Our individuality, our choices, and our freedom. But we've allowed it to become this way. We all know deep in our souls that he's right, but until someone like him speaks it, we're at a loss.
